Terms of Service

By accessing or using Banana Prompts ("the Service"), operated by Banana Prompts ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Banana Prompts. Your continued use of Banana Prompts following the posting of any changes to these Terms constitutes acceptance of those changes.

Banana Prompts is an AI-powered image generation software-as-a-service (SaaS) platform. Rather than typing freeform text prompts, users create images through a structured recipe system that allows selection across multiple visual dimensions including subject, style, scene, mood, lighting, color palette, and more.

The recipe builder offers three progressive levels of complexity:

• Level 1 — 5 core dimensions: subject, style, scene, mood, and aspect ratio.
• Level 2 — 10 dimensions adding light, color, depth, pose, and texture.
• Level 3 — 17 dimensions adding composition, angle, weather, features, quality, reference, and negative prompts.

The Service also includes a public discover gallery, image library, and account management features. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

To generate images, you must create an account by providing a valid email address and password, or by authenticating through a supported third-party provider (e.g., Google). You agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials and not share them with others.
• Verify your email address before accessing generation features.
• Accept responsibility for all activity that occurs under your account.

Browsing the discover gallery and public areas of Banana Prompts does not require an account.

Banana Prompts operates on a credit-based system. Credits are required to generate images and access premium features.

Credit Packages

Credits can be purchased through the following packages:

• Starter — 50 credits for $4.99
• Standard — 150 credits for $12.99
• Pro — 400 credits for $29.99

Credit Usage

• Image generation costs 2 credits per image.
• HD image download costs 4 credits per download.
• New accounts receive a one-time signup bonus of 20 credits.

Image Expiration

Generated images are available for 24 hours from the time of creation. After this period, images may be automatically removed from our servers. You are responsible for downloading any images you wish to keep within this window.

Payment Processing

All payments are securely processed through Stripe. By making a purchase, you agree to Stripe's terms of service. Credits are non-refundable once purchased, except as required by applicable law. Credits have no cash value and cannot be transferred between accounts.

The Banana Prompts platform, including its design, software, logos, and branding, is the intellectual property of Banana Prompts and is protected by applicable intellectual property laws.

Regarding AI-generated images created through the Service:

• You retain the rights to use images you generate through Banana Prompts, subject to these Terms and applicable law.
• You acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions.
• By making images public on the discover gallery, you grant Banana Prompts a non-exclusive, worldwide license to display those images on the platform.
• We do not claim ownership of your generated images, but we may use anonymized, aggregated usage data to improve the Service.

You agree not to use Banana Prompts to generate, upload, or distribute content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Depicts or promotes child sexual abuse material (CSAM) in any form.
• Infringes on the intellectual property rights of any third party.
• Contains realistic depictions of identifiable individuals without their consent.
• Is intended to deceive, defraud, or mislead others, including deepfakes used for malicious purposes.
• Violates any applicable local, national, or international law or regulation.

We reserve the right to review generated content through our moderation system and to suspend or terminate accounts that violate these guidelines without prior notice or refund.

We may suspend or terminate your account at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason.

You may delete your account at any time by contacting us at [email protected]. Upon termination:

• Your right to access and use the Service will immediately cease.
• Any remaining credits in your account will be forfeited and are non-refundable.
• Generated images associated with your account may be permanently deleted.

To the maximum extent permitted by applicable law, Banana Prompts and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated images will meet your specific requirements.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Germany.

We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Material changes may be communicated via email or through a notice on the Service.

Your continued use of Banana Prompts after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
